Understanding the Eviction Process

Evictions can be stressful for both landlords and tenants. Whether you are a landlord trying to regain possession of your property or a tenant trying to understand your rights and respond properly, the eviction process must be handled correctly from the very beginning.

Step One: The Eviction NoticeThe eviction process begins with a legally served notice.
This is one of the most important steps in the entire case because the type of notice depends on the reason for the eviction. A landlord may need to serve a notice for nonpayment of rent, lease violations, nuisance, unlawful detainer, or another legally recognized reason.
The notice must be served properly. In many cases, this may be done by a constable, sheriff, or licensed process server. If the notice is not prepared correctly or served properly, it may delay the case or create problems once the matter reaches court.

Step Two: Tenant Response and Court ActionAfter the notice period expires, the landlord may be able to file for a Summary Eviction with the court.

Tenants also have options. If a tenant disagrees with the eviction notice, needs more time, or believes there is a legal reason the eviction should not move forward, the tenant may have the ability to file a response with the court.

Step Three: Court Review and Possible Eviction OrderOnce the documents are filed, the court reviews the matter. Depending on the situation, the court may set a hearing or may make a decision based on the filings.
If the judge grants the eviction, the eviction order is sent to the proper constable’s office. For Henderson matters, this may involve the Henderson Township Constable.
This step is important because landlords cannot simply change locks or remove a tenant on their own. The lockout must be handled through the proper legal process.
Step Four: Lockout by the ConstableIf the court grants the eviction order, the constable carries out the lockout according to the court’s order.
This is the final stage of the eviction process. By this point, the paperwork, notice, filing, court review, and order must all be handled correctly.
